If you disagree with any part of these Terms and Conditions, please do not use our Site. We reserve the right to change these Terms and Conditions from time to time and we advise you to read through them each time you use our Site.

You must be over 18 years old to purchase goods from our Site. If you are under 18, you must let your parent or guardian know about Russell & Bromley Online Limited's Privacy Policy before you register to use our Site or any of our Site's services.

Terms of Sale

When you place an order on our Site you automatically agree to our Terms and Conditions. After you place an order, you will be taken to our "Order Receipt page", which confirms all your details, your order, and your order reference number. However, please note that this does NOT mean that your order has been accepted.

All card payments are subject to authorisation by your card issuer and we take payment on the day that the order is placed. Once your details have been verified you will receive your 'Order Confirmation' email. Unless you cancel your order, acceptance of your order is when we dispatch the goods and completion of the contract between you and Russell & Bromley Online Limited is when you receive the goods. We will send you a Dispatch Confirmation email confirming that the order has been dispatched. Up until the point of dispatch your order may be subject to further validation checks.

We can only accept orders for items that are shown on the Site as being in stock. If an item is out of stock we offer a facility for you to receive an email when the item is back in stock. In the unlikely event that we cannot supply you with any or all of the items you ordered we will inform you by email. If you have already paid for the item we will refund you in full as soon as reasonably possible.

We reserve the right to refuse to supply any person for any reason at any time at our sole discretion, including, but not limited to, our inability to obtain authorisation for payment. We will not be liable to you or any third party by reason of our withdrawing any merchandise from the Site; removing, screening or editing any materials or content on the Site; refusing to process a transaction or unwinding or suspending any transaction after processing has begun.

Availability

We do not provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this Site for any particular purpose. The images of the products available on our Site are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that your computer's display accurately reflects the colour of the products. Our products may vary slightly from those images. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

All products shown on our Site are subject to availability.

Pricing and VAT

All prices are inclusive of UK VAT.

Orders must be placed using a UK billing address and are charged in British Pounds (GBP).

Payment

Payment may be made using Apple Pay (on supported devices), PayPal or a debit/credit card. The card used must be registered to the billing address given. We accept the following cards: American Express, Maestro, Mastercard, Visa, and Visa Electron. Payment will be debited and cleared from your account upon receipt of your order by Russell & Bromley Online Limited. You confirm that the credit/debit card that is being used is yours. All credit/debit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to Russell & Bromley Online Limited, we will not be liable for any delay or non-delivery.

Orders placed using PayPal will only be dispatched if the payment qualifies for PayPal Seller Protection. This extra level of protection reduces the risk of internet fraud by ensuring the addresses provided are verified by PayPal. Russell & Bromley are unable to influence PayPal’s decision to offer Seller Protection on a payment and we reserve the right to cancel the sale if the order does not qualify for this cover.

We take reasonable care to make our Site secure. All credit/debit card transactions on this site are processed using Adyen, a secure online payment gateway that encrypts your card details in a secure host environment.

When you register with russellandbromley.co.uk you are given the opportunity to securely store your credit card details on our systems. These details will be fully encrypted and only used to process card transactions.

We will validate name, address and other personal information supplied by you during the order process against appropriate third party databases. By registering with russellandbromley.co.uk you are accepting these Terms and Conditions and consenting to such checks being made. In performing these checks personal information may be disclosed to a registered Credit Reference Agency which may keep a record of that information. You can rest assured that this is done only to confirm your identity, that a credit check is not performed and that your credit rating will be unaffected. All information provided by you will be treated securely and strictly in accordance with the Data Protection Act 1998.

Furthermore, we will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the Site.

Amendments

We are unable to amend an order once it has been placed. Please ensure you check your order details are correct before submitting it to us.

Dispatch and Delivery

Orders can be delivered either to an address within Great Britain and Northern Ireland or to a UK branch of Russell & Bromley. We are unable to deliver to PO Box addresses and freight forwarding addresses.

We will endeavour to deliver within the timeframes stated. Sometimes, factors outside of our control will prevent us from delivering on time. At peak times we may lengthen estimated delivery times or suspend next day delivery options.

We are responsible for each package until it is delivered (or, in the case of an order delivered to store, when the goods are in your possession) at which point responsibility for your purchased goods transfers to you. If a signature is obtained from someone other than you at the delivery address you have specified then you accept that this signature constitutes evidence of delivery and responsibility for the goods transfers to you in the same way.

If you are not at home when the courier attempts to deliver you will be notified telling you where your order can be collected from or notifying you when delivery will be attempted again.

If the parcel you receive is damaged or has been tampered with please check the contents before accepting it from the courier and reject the package if there are items missing.

Disputed deliveries will be fully investigated with the couriers and may take up to 10 business days (from the time we are notified) to be resolved.

Return and Refund Policy

If you are not completely satisfied with your online purchase, we offer to refund unworn, full priced items within 28 days and sale items within 14 days (from the day the goods were delivered to you).

The items must be unused and returned in a resalable condition in the original packaging. We cannot accept responsibility for goods lost or damaged in transit.

Refunds are processed via the original payment method within 7 business days of receipt. Funds may take a further 5 working days to appear in your account.

Returns

You can return any of the items that you purchased online for a refund by using one of the following methods of return:

• Return to your local Russell & Bromley shop (excluding Dublin)

• Free return using Royal Mail via your local Post Office

• Free return using Yodel via your local participating shop

Cancelling Your Order

Customers based in the EU have a right to cancel an entire order with us under the Consumer Contracts Regulations 2013, providing you give us written notification any time after the order has been placed, up until 14 working days from the day you received your order.

Your notification must specify that you wish to cancel the entire order under the Consumer Contracts Regulations 2013. The item must be returned in a resalable condition in the original packaging within 28 days of you receiving it. We will refund your original order in full, including any postage paid, within 14 days of the entire order being back in our possession or (if earlier) evidence being provided confirming the order has been returned. You are responsible for any shipping costs and insurance. We cannot accept responsibility for goods that are lost or damaged in transit.

Viruses, Hacking and Other Offences

You must not misuse our Site by knowingly introducing viruses, Trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our Site, the server on which our Site is stored or any server, computer or database connected to our Site. You must not attack our Site via a denial-of-service attack or a distributed denial-of-service attack.

By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our Site will cease immediately.

We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our Site or to your downloading of any material posted on it, or on any website linked to it.

Russell & Bromley is dedicated to providing a website that is accessible to all users and will continue to adhere to the guidelines of the Disability Discrimination Act.

Gift Cards

eGift Cards can be purchased online here and can be redeemed at russellandbromley.co.uk and in our UK stores within 24 months of purchase. Recipients will receive their gift card within 2 hours and are able to spend them right away.

eGift Cards cannot be purchased alongside other items, but multiple eGift Cards can be bought together and sent to multiple recipients. A maximum of £1,000 eGift Cards can be purchased in one transaction.

Gift Cards, both physical and digital, cannot be purchased using promotional or discount codes, other Gift Cards and are non-refundable. Gift Cards are excluded from our Loyalty programme so Loyalty members will not accrue points on Gift Card purchases.

Both eGift Cards and physical Gift Cards purchased in our stores (excluding those purchased in our Dublin store), can be redeemed on the Russell & Bromley website, and can be used to fully or partially pay for anything on site (excluding new eGift Cards).

When redeeming an eGift Card or physical Gift Card, the full value of the order (if available on the Gift Card), will be taken from your Gift Card, leaving the remaining Gift Card balance. If the full order value is not available on your Gift Card, the full value of the Gift Card will be used, leaving an order balance to be paid via another payment method, excluding PayPal.

Should you need to return an item that was purchased using an eGift Card or physical Gift Card, you will receive a replacement eGift Card for the appropriate value. Orders that contained another payment method will be refunded in favour of the other payment method first (up to the amount paid), followed by any remaining balance being returned via a new eGift Card. eGift Cards issued as part of a returned order will be sent to the email address supplied for the order that the original an eGift Card or physical Gift Card was used.

Gift Code

Gift codes can only be used online.

Gift codes can be redeemed against full price items only.

Gift codes can only be used once.

Gift codes can only be used by the recipient.

Gift codes cannot be used in conjunction with any other promotional code.

If all items in an order placed using the promo code are returned, the promo code cannot be reused.

If a part order is returned a percentage discount will be deducted when a refund is issued.

The email sign up code is valid from 15th February 2024 00:05 until 13th June 2024 23:59.

Email sign up gift codes can only be used on first purchases, when signing up to our database.

Russell & Bromley reserves the right to end this promotion early.

Other Important Terms

This contract is between you and us. No other person shall have any rights to enforce any of its terms.

Each of the paragraphs of these Terms operates separately, if any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.

The Terms and Conditions together with all our policies and procedures will be governed by and construed in accordance with the laws of England. Your use of this Site and any dispute arising out of such use of the Site is subject to the laws of England. The Terms and Conditions (as amended from time to time) constitutes the entire agreement between you and Russell & Bromley Online Limited regarding your use of this Site and supersedes any other agreement or understanding, arrangements, undertaking or proposal, written or oral, between you and Russell & Bromley Online Limited in relation to such matters. In the event that any other rules, code of conduct or other matter posted on this Site conflicts with the Terms and Conditions, the Terms and Conditions shall govern.

No waiver by us shall be construed as a waiver of any proceeding or succeeding breach of any provision.
